Terms of Service

1. Acceptance of Terms

By accessing or using the CustomizeBoxLab website at www.customizeboxlab.com (the "Site") and/or placing an order with CustomizeBoxLab ("Company", "we", "us", or "our"), you ("Customer", "you", or "your") agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you must not use our Site or services. These Terms apply to all visitors, users, and customers.

2. Orders & Quotes

2.1 Quote Requests

Quote requests submitted through our website are not binding contracts. A quote becomes binding only when confirmed in writing by both parties and a deposit payment is received.

2.2 Order Confirmation

An order is confirmed when: (a) we have provided a written order confirmation, (b) the Customer has approved the final artwork proof, and (c) the required deposit has been received.

2.3 Minimum Order Quantity

Our standard minimum order quantity (MOQ) is 100 units per product per order. Different products may have different MOQs as specified in individual product quotes.

2.4 Pricing

All prices are quoted in US Dollars (USD) unless otherwise stated. Prices do not include applicable taxes, duties, or shipping costs unless explicitly stated in writing. Quoted prices are valid for 30 days from the date of the quote unless otherwise stated.

3. Artwork & Intellectual Property

3.1 Customer Artwork

By submitting artwork, logos, images, or designs to us, you represent and warrant that:

• You own or have the legal right to use all submitted artwork and intellectual property.
• The artwork does not infringe any third-party copyright, trademark, or other intellectual property rights.
• The artwork does not contain any unlawful, defamatory, or offensive content.

You grant us a non-exclusive license to use your artwork solely for the purpose of producing your order. We will not use your artwork for any other purpose without your written consent.

3.2 Our Intellectual Property

All content on our Site including text, graphics, logos, designs, and software is the property of CustomizeBoxLab and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

3.3 Artwork Approval

The Customer is solely responsible for reviewing and approving all digital proofs before production. Once a proof is approved, CustomizeBoxLab assumes no responsibility for errors in the approved artwork including spelling, grammar, color, or design elements.

4. Payment Terms

• A deposit of 50% of the total order value is required to begin production.
• The remaining 50% balance is due prior to shipment unless a credit account has been established.
• We accept payment via credit/debit card, bank wire transfer, PayPal, and Stripe.
• All payments must be received in USD unless otherwise agreed in writing.
• Late payments may be subject to a 1.5% monthly interest charge.

5. Production & Delivery

5.1 Production Times

Standard production times are 8–15 business days after artwork approval and deposit receipt. Production times are estimates and not guaranteed unless expressly stated in writing.

5.2 Shipping

Shipping times and costs are in addition to production time and costs. Risk of loss and title for all products pass to the Customer upon delivery to the shipping carrier. We are not liable for delays caused by the shipping carrier, customs, or circumstances beyond our control.

5.3 Quantity Tolerance

Due to the nature of manufacturing, delivered quantities may vary by up to ±5% of the ordered quantity. Payment will be adjusted accordingly based on the actual quantity delivered.

6. Quality Guarantee & Returns

6.1 Quality Guarantee

We guarantee that all products will be manufactured in accordance with the approved proof. If your order contains a manufacturing defect, we will, at our discretion, either reprint the defective portion or provide a credit/refund.

6.2 Claims Process

All quality claims must be submitted within 14 calendar days of delivery with photographic evidence and the order number. Claims submitted after this period may not be accepted.

6.3 No Returns for Approved Artwork

Custom-printed products cannot be returned or refunded if they match the approved artwork proof. The Customer is responsible for ensuring artwork is correct before approving.

6.4 Color Variation

Minor color variations between the digital proof and final printed product are inherent in the printing process and are not considered defects unless they significantly deviate from the approved proof.

7. Cancellations

Orders may be cancelled before production begins with a full refund of the deposit, less any design or sampling costs incurred. Once production has begun, orders cannot be cancelled and the deposit is non-refundable. Cancellation requests must be submitted in writing.

8. Limitation of Liability

To the maximum extent permitted by applicable law, CustomizeBoxLab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, or loss of business opportunities.

Our total liability to you for any claim arising out of or in connection with an order shall not exceed the total amount paid by you for that specific order.

9. Indemnification

You agree to indemnify, defend, and hold harmless CustomizeBoxLab and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from: (a) your use of our services; (b) your violation of these Terms; or (c) any claim that your artwork infringes any third-party intellectual property rights.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict of law provisions. Any dispute arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Chicago, Illinois.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
